By accessing or using Detention Haul ("the Service"), you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access the Service.
2. Description of Service
Detention Haul is a software-as-a-service (SaaS) platform designed for trucking carriers and owner-operators to track, calculate, and bill detention fees. The Service includes:
- Arrival and departure logging with optional GPS tracking
- Automated detention fee calculation based on configurable rates and rules
- Professional invoice generation and delivery
- Data storage and reporting features
- AI-powered collection email customization
3. User Accounts & Responsibilities
To use the Service, you must create an account and provide accurate, complete information. You are responsible for:
- Maintaining the security of your account credentials
- All activities that occur under your account
- Ensuring your use of the Service complies with applicable laws and regulations
- Providing accurate information when logging detention events
- Obtaining necessary permissions before using GPS tracking features on mobile devices
4. Payment Terms
Detention Haul operates on a subscription-based model:
- Subscriptions are billed monthly in advance
- All fees are non-refundable except as required by law
- You authorize us to charge your payment method on a recurring basis
- Price changes will be communicated 30 days in advance
- Failure to pay may result in suspension or termination of your account
- We offer a 14-day free trial period for new users
5. Intellectual Property
The Service and its original content, features, and functionality are owned by Detention Haul and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
You retain ownership of data you upload to the Service. By using the Service, you grant us a limited, non-exclusive license to use, store, and process your data solely to provide and improve the Service.
6. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DETENTION HAUL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
7. Termination
We may terminate or suspend your account immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.
You may cancel your subscription at any time. Upon cancellation, you will continue to have access to the Service until the end of your billing period. We will retain your data for 30 days after cancellation, after which it may be permanently deleted.
8. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Service. Your continued use of the Service after changes become effective constitutes acceptance of the new Terms.
